In a response to a recently passed California law, Texas Congressman Troy Nehls responded on Twitter claiming it allows doctors to perform “gender transition” surgeries on children without parental consent. To find out if this is true, we turned to California Senate Bill 107, the California Welfare and Institutions Code and Rebecca Gudeman with the National Center for Youth Law. QUESTION: Does a California law allow doctors to perform gender affirming surgery without parental consent? ANSWER: No, it does not. In general, California doctors can provide limited services without parental consent unless the minor is emancipated or lives in California and is completely financially separate and apart from their parents.
